1. Acceptance of Terms

By accessing or using the StopSmoke mobile application, the website at https://stopsmoke.net, and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("you" or "User") and StopSmoke ("we," "our," or "us"). By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

StopSmoke is a mobile application and web platform that provides tools for users who wish to track and reduce their smoking and vaping habits. The Service includes, but is not limited to:

• Daily cigarette and vape puff tracking and logging
• Real-time financial savings calculations based on self-reported data
• Health recovery milestone tracking based on publicly available medical research
• Daily usage limits and goal-setting features
• Educational blog content about smoking cessation
• Newsletter and subscription services

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Medical Disclaimer

You acknowledge and agree that:

• You should always consult a qualified healthcare professional before making any changes to your smoking or vaping habits, especially if you have underlying health conditions
• The Service does not provide personalized medical advice and cannot account for your individual health circumstances
• Nicotine withdrawal may cause side effects including but not limited to irritability, anxiety, difficulty concentrating, increased appetite, and sleep disturbances — consult your doctor for guidance
• Any savings calculations are estimates based on self-reported data and may not reflect actual financial outcomes
• We make no warranties or representations about the accuracy, completeness, or reliability of any health information provided through the Service

4. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to breach of these Terms. You may delete your account at any time by contacting us at support@stopsmoke.net.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers, crawlers) to access the Service without our express written permission
• Harass, abuse, or harm other users or our staff through the Service
• Use the Service for any purpose other than its intended personal health-tracking function

Violation of these terms may result in immediate termination of your account and, where applicable, legal action.

6. Intellectual Property

The Service and its entire contents, features, and functionality — including but not limited to all information, software, code, text, displays, graphics, photographs, images, video, audio, design, presentation, selection, and arrangement — are owned by StopSmoke, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.

7. Subscription & Free Trial

StopSmoke may offer a free trial period for early subscribers, limited to the first 1,000 subscribers ("Trial"). The availability, duration, and terms of the Trial are at our sole discretion and may change without notice.

Subscribing to the website newsletter does not guarantee access to the Trial. Trial eligibility is determined at the time of app registration and is subject to availability. We reserve the right to modify or terminate the Trial program at any time.

Following the Trial period, continued access to premium features will require a paid subscription. Subscription pricing, billing cycles, and payment terms will be communicated before any charges are applied. You will not be charged without your explicit consent.

We reserve the right to change subscription pricing at any time. Any price changes will be communicated to existing subscribers in advance and will take effect at the start of the next billing cycle.

8. Limitation of Liability

Without limiting the foregoing, we specifically disclaim liability for:

• Any health outcomes, injuries, or medical conditions arising from or related to your use of the Service or your decision to quit or reduce smoking or vaping based on information provided by the Service
• Inaccuracies in savings calculations, health milestones, or any other data presented by the Service
• Loss of data, including tracking history, savings data, and account information, due to technical failures, security breaches, or any other cause
• Any interruption, suspension, or termination of the Service, whether planned or unplanned
• Actions or omissions of third-party service providers used in connection with the Service
• Any unauthorized access to or alteration of your account, transmissions, or data

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless StopSmoke, its directors, officers, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; (d) any claim that your use of the Service caused damage to a third party; or (e) any content you submit through the Service. This defense and indemnification obligation will survive these Terms and your use of the Service.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us at support@stopsmoke.net.

All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which StopSmoke operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You agree that any arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service and may request deletion of your account.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and StopSmoke concerning the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
